Any agreement for the purchase of goods from ROBERT E. DE BARTH and the Customer shall be subject to these Business Policies, Terms and Conditions. By placing an order, Customer consents to and agrees to abide by any and all of the following Terms and Conditions.
Payment Methods
ROBERT E. DE BARTH now accepts checks by phone and E-Mail in addition to Cashier's Checks, Certified Checks, US Postal Money Orders, or International Money Orders made for US Dollars for all goods and services. Visa and Master Card credit card transactions are still accepted for pre-approved accounts. Personal, business, and other forms of unsecured drafts may delay order shipments up to one week for domestic drafts and up to four to six weeks for international drafts. If you have a Pennsylvania shipping address, we will add 6% State Sales Tax to the invoice amount. ROBERT E. DE BARTH will only process and ship pre-paid orders unless open order arrangements have been made prior to shipment of order.
Prices
ROBERT E. DE BARTH’s Web Site prices are updated frequently and are current to the best of our knowledge when posted. However, because of the dynamic nature of the electronic and computer industry, some products, prices, manufacturer promotions, or offers may change before we are able to update and post the information on this Web Site. In case of an unexpected cost increase or other change, we will contact you to determine whether you want to continue your order at the new price or cancel your order. We reserve the right to decline the acceptance of any Customer order.
Warranty
ROBERT E. DE BARTH makes no warranty of any kind with respect to the information posted on this Web Site. While ROBERT E. DE BARTH makes every effort to ensure the accuracy of posted data, this Web Site could include typographical errors and technical inaccuracies. In addition, photos may not represent actual products.
Manufacturer Warranties
If a manufacturer warranty applies to your purchase, ROBERT E. DE BARTH disclaims all other warranties including but not limited to warranties of merchantability and fitness for a particular purpose.
Liabilities
In no event shall ROBERT E. DE BARTH be liable for any damages caused by any product or failure of such product to perform, whether or not advised of the possibility of such damage and regardless of the theory of liability pursuant to which such damages may be sought.
Returns and Order Cancellations
All claims for returns must be made within thirty (30) days of invoice date. Product returns may be subject to Manufacturer Restrictions. Not all products are eligible for return. Customer agrees to follow the ROBERT E. DE BARTH’s Return Policy & Procedures to request a Return Merchandise Authorization Number (RMA#) from ROBERT E. DE BARTH before attempting to return any products. See Return Policy & Procedures. An order cancellation fee may be charged to the Customer’s account for any order cancelled by Customer for any reason before the Customer's order is shipped. Not all orders are subject to cancellation by Customer. Orders that have been shipped are not subject to cancellation for any reason. All cancelled orders after shipment to the customer are subject to ROBERT E. DE BARTH’s Return Policy & Procedures.
Shipping
ROBERT E. DE BARTH will only ship to legal shipping addresses. ROBERT E. DE BARTH does not ship to P. O. Boxes unless on a rural route including a legal street address. All orders are shipped only to customer's legal shipping address. No third party or drop shipments are made by ROBERT E. DE BARTH. Customer's preferred shipping methods will always be honored however there may be delays in actual shipping date and or services. There may also be standard or additional handling fees assessed for special handling of customer's order.
Damaged Shipments
If you are in the Continental U.S. and receive a shipping carton from a package carrier (UPS, Federal Express or another recognized commercial carrier) that shows obvious damage, then refuse the shipment and contact ROBERT E. DE BARTH immediately. If upon opening a shipping carton, you discover concealed damages, then contact ROBERT E. DE BARTH immediately to arrange for inspection. In both cases, ROBERT E. DE BARTH will arrange for a replacement.
Claims
If Customer makes any claims against ROBERT E. DE BARTH, Customer agrees that the venue for such claims will be in the County of Montgomery, Lansdale, Pennsylvania, USA
Customer Credit Card Charges
Customer authorizes ROBERT E. DE BARTH if necessary, to charge their (Customer’s) Credit Card for any restocking fees, collection fees, or any other related charges for any transaction initiated by the customer and that these additional charges may be assessed against the Customer without further authorization from the customer. Any additional charges may include the cost of products purchased, shipping charges, restocking fees, or other costs to satisfy a customer’s account.
All fees are based on costs of reversing business transactions initiated by the Customer. Order cancellation fees are applied to Customer's purchase price only. For all orders cancelled before shipment for any reason there may be a cancellation fee of 20% of the purchase price or $ 20.00, whichever is greater, assessed to the Customer's account or against any authorized credit. Any authorized return, with a valid RMA number, may be assessed a $ 25.00 or 25% re-stocking fee, whichever is greater, charged to the Customer's account or against any authorized credit. Shipping and Handling charges are not refundable under any circumstances. Special orders are not subject to return or cancellation by the Customer for any reason.
